Covenant & Bylaw Amendments

 

Most covenants and bylaws will be amended at some point in the life of a residential or commercial development. Drafting reasonable language is part of the work we do, along with guiding clients through the specific process of how to properly conduct voting meetings, send notice, obtain ballots, and final adoption of the proposed amendment language. The firm routinely provides opinions to clients on the proper methods for amendment, and often assists clients when prior methods or efforts were incorrect or unsuccessful.

The firm is uniquely experienced in assisting clients with amendment issues such as restrictive period limitations, use of 11 O.S. 42-106.1, and adoption of association amendments under 106.1(D).

The firm provides developer and builder clients comprehensive community association assistance. From drafting governing documents commensurate with the client’s marketing and sales goals to coordinating and facilitating the first association meeting, sometimes called “turnover,” our firm has extensive experience to assist the developer client. The firm has represented small and large, in-state and out of state development groups with their land use needs. We have assisted with the conversion of existing buildings into commercial and residential condominiums so as to avoid replatting and lot splits. Our attorneys draft governing documents to include clear developer-declarant protections, architectural committee design review guidelines and forms, reserved developer rights, approved builder programs, each designed to assist the client land use goals.
